TERMS AND CONDITIONS OF SALE — STORXMARKET

ARTICLE 1 — LEGAL NOTICE

StorxMarket is operated by a private individual (hereinafter "the Seller").

ARTICLE 2 — SCOPE

These Terms and Conditions of Sale (hereinafter "T&Cs") apply to all sales of digital products (hereinafter "Products") made through the StorxMarket website, to any non-professional individual (hereinafter "the Customer").

By completing a purchase, the Customer fully and unconditionally accepts these T&Cs and acknowledges having read them prior to validating their order.

ARTICLE 3 — PRODUCTS

The products offered for sale on StorxMarket are digital goods (software, downloadable files, licenses, etc.).

The essential characteristics of each product are described on the corresponding product page. The Seller ensures that all information provided is accurate and up to date.

ARTICLE 4 — PRICING

All prices are listed in euros (€), inclusive of all applicable taxes.

The Seller reserves the right to modify prices at any time. The applicable prices are those in effect at the time the Customer validates their order.

ARTICLE 5 — ORDERS

An order is confirmed after:

  1. Selection of the product(s) by the Customer
  2. Entry of payment information
  3. Validation and successful payment of the order

The Seller reserves the right to refuse or cancel any order for a legitimate reason, including prior disputes, suspected fraud, or payment issues.

ARTICLE 6 — PAYMENT

Full payment is required at the time of purchase. Accepted payment methods are those made available by the Shopify platform at the time of purchase (credit/debit card, etc.).

Payment data is processed securely by Shopify Payments. The Seller does not have access to the Customer's banking details.

ARTICLE 7 — DELIVERY OF DIGITAL PRODUCTS

Digital products are made available to the Customer immediately upon payment confirmation, electronically (download link, personal account access, email delivery, etc.).

In the event of a delivery issue, the Customer is invited to contact the Seller at the address listed in Article 1 as soon as possible.

ARTICLE 8 — RIGHT OF WITHDRAWAL

In accordance with applicable consumer protection law, the right of withdrawal does not apply to digital content provided on an intangible medium where execution has begun with the Customer's prior express consent and waiver of their right of withdrawal.

By validating their order and accessing the digital product, the Customer expressly acknowledges waiving their right of withdrawal.

As a result, no refund will be granted once the product has been downloaded or made accessible.

ARTICLE 9 — WARRANTIES AND LIABILITY

The Seller warrants that digital products conform to their description at the time of sale.

The Seller shall not be held liable for:

  • Any indirect damage resulting from the use of the products
  • Any incompatibility with the Customer's hardware or software not disclosed on the product page
  • Any use of the products that does not comply with their terms of use

In the event of a proven non-conformity, the Customer may contact the Seller to seek an amicable resolution.

ARTICLE 10 — INTELLECTUAL PROPERTY

All digital products sold on StorxMarket are protected under applicable intellectual property laws. The purchase of a digital product grants the Customer a personal, non-exclusive, and non-transferable license to use the product.

The Customer is strictly prohibited from:

  • Reproducing, distributing, or reselling the products without prior authorization
  • Sharing files or access credentials with third parties
  • Using the products for commercial purposes without prior written consent from the Seller

Any violation of these rights may result in legal proceedings.

ARTICLE 11 — PERSONAL DATA

Personal data collected during the ordering process (name, email, address) is used solely for order processing and customer relationship purposes.

In accordance with applicable data protection regulations (including the GDPR), the Customer has the right to access, rectify, and delete their personal data by contacting the Seller at the address listed in Article 1.

ARTICLE 12 — DISPUTE RESOLUTION

In the event of a dispute, the Customer is encouraged to first contact the Seller by email in order to reach an amicable resolution.

If no amicable resolution can be reached, the Customer may use a free consumer mediation service. The Seller agrees to participate in any mediation procedure.

ARTICLE 13 — GOVERNING LAW

These T&Cs are governed by French law. Any dispute falls under the jurisdiction of the competent French courts.

By placing an order on StorxMarket, the Customer acknowledges having read, understood, and accepted these Terms and Conditions of Sale in their entirety.
